Press Release: TOC FOUNDATION TO OPPOSE ACA5

Irvine, California, June 17, 2020 – Irvine-based TOC Foundation (TOCF) joins our partner organizations and individuals across Orange County in expressing our strong opposition to Assembly Constitutional Amendment 5 (ACA5), which will intensify racial tensions and further divide the people of California. 

ACA-5, which was introduced by Democratic Assemblywoman Shirley Weber, would repeal Proposition 209, the 1996 voter-passed initiative that prevents government discrimination based on race and other factors. By doing so, it grants California government and its agencies the right to discriminate in favor of their chosen groups of people at the expense of other groups. This is an outrageous violation of human rights in a democratic country where everyone is entitled to equal rights. 

The Democratic legislators are clearly taking advantage of the COVID-19 pandemic crisis that is hurting all Americans. This stealth effort circumvents a thorough vetting process, which is essential to inform California residents of its content and implications. It is irresponsible and despicable. 

The evidence shows that California institutions, such as the University of California, not only maintain great racial diversity but also quality of education. In fact, under-represented minority students have significantly higher graduation rates now than before the adoption of Proposition 209. On the labor front, black employees represent 11% of total California government jobs while representing only about 6% of California’s population. 

TOC Foundation supports the 1964 U.S. Civil Rights Act, reflected in Proposition 209 that, “The state shall not discriminate against, or grant preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in the operation of public employment, public education, or public contracting.” We also cherish the desire of our society to help those that are less fortunate and privileged due to socioeconomic level, across all racial groups and communities. This is how we can make American strong and united. Unfortunately, ACA-5 will do exactly the opposite by addressing inequality with institutional discrimination.
